One of the More Interesting EULA’s I Have Read

Looking into working some Canadian Earthquake data into my plug-in code, and was looking at the EULA and #9 stood out and caught my eye.

9) The End-User shall indemnify and save harmless Canada and its Ministers, officers, employees and agents from and against any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action, alleging loss, costs, expenses, damages or injuries (including injuries resulting in death) arising out of the End-User’s use or possession of the Digital Data or in any way relating to this Agreement.

“save harmless Canada” … Canada?  Harmless? ;)   I am trying to figure out how death can result from possession of data though.. I guess if you print it, you could get a paper cut.

    Surely in the litigious world in which we live you can imagine someone trying to sue them over fault data that wasn’t correct or wasn’t there… or any manner of obscene distortions. Its a deep pocket.

    I suppose if someone integrated the Canadian street centerline data into a GPS navigation unit and then drove into a lake and drowned, you’ve managed to die from being an idiot.

    I live in Oregon, where you all might remember that James Kim from CNET.com followed bad routing data from his GPS Navigation Device and froze to death in very rugged terrain. He was following a shortest distance route that he should never of been on during that time of the year. Such tragedies to occur when data isn’t used properly.
